1) This is an appeal under Section 14-A of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SCST Act), challenging order dated 2 May 2024 passed by the Additional Sessions Judge, Solapur, rejecting the application filed by the Appellant for anticipatory bail in connection with the Crime No.191 of 2024 registered with Faujdar Chavdi Police Station, District-Solapur, for offences punishable MEGHA SHREEDHAR PARAB under Sections 376, 376(2)(n), 504 and 506 r/w 34 of the IPC and Section 3(1)(w)(ii), 3(2)(va) of the SCST Act.
MEGHA SHREEDHAR PARAB Date: 2024.06.25 13:47:55 +0530 2) Appellant is the mother of the first accused against whom there is allegation by the first informant with regard to keeping sexual relationship 1 of
under promise of marriage as well as while being in live-in-relationship. Apparently, accused No.1 is arrested and released on bail. The role sought to be attributed to the Appellant in the FIR is with regard to the incident of 29 February 2024 during Haldi ceremony of the first accused when first informant questioned purpose of marriage of the first accused with another woman and the Appellant allegedly assaulting and abusing the first informant with reference to her caste.
3) Issue notice to Respondent No.2, returnable on 30 July 2024. 4) Considering the facts and circumstances of the present case, in my view the Appellant deserves to be granted interim protection till the next date of hearing on the following terms and conditions:- (i) In the event of arrest of the Appellant in connection with the Crime No.191 of 2024 registered with Faujdar Chavdi Police Station, District-Solapur, the Appellant shall be released on interim bail on executing PR bonds in the sum of Rs.25,000/- with one or two sureties in the like amount.
(ii) The Appellant shall co-operate with the investigation. (iii) The Appellant shall not interfere with the complainant and other witnesses and shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
(iv) The Appellant shall keep the Investigating Officer informed of her current address and mobile contact numbers, and/or 2 of
change of residence or mobile details, if any, from time to time.
