P.C. :- 1) Heard the learned counsel appearing for the Appellants. Issue notice to Respondent No.2, returnable on 12 August 2024. 2) I have gone through the FIR, it appears that the main accused Aniruddha Koli against whom there is an allegation of assault by use of sword has already been arrested. The role ascribed to the Appellants, who are mother and wife of the main accused Anirudha, is alleged assault by stick. 3) It appears that the injuries allegedly caused to complainants are attributable the alleged assault by the main accused Aniruddha. Sonali Mane 38-apeal-686-24.doc 4) In that view of the matter, interim protection deserves to be granted in favour of the Appellant. I accordingly proceed to pass the following Order : (a) In the event of arrest of the Appellant in C.R. No. 154 of 2024 registered with Solapur Police Station, Pune for offences punishable under Sections 307, 354, 324, 143, 147, 148 read with Section 149 of the Indian Penal Code, Sections 4 and 25 of the Arms Act,1959 and under Section 3(2)(va), 3(1)(r) and 3(1)(s) of the S.C.S.T. Act., he shall be enlarged on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Appellant shall appear before the Investigating Officer on 22 and 23 July 2024 between 11.00 to 2.00 p.m. and shall co-operate with the conduct of investigations.
(d) Appellant shall furnish identity and address proof of himself and of his two blood relatives while furnishing sureties. (e) Appellant shall attend Trial Court regularly unless exempted from personal appearance.
(f) Appellant shall not pressurize the informant or any other witnesses acquainted with the facts of the case nor shall tamper with the evidence either directly or indirectly.
(g) The Appellant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Trial Court as well as to the concerned Police Station in writing.
