IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO. 982 OF 2024 Radha Rahul Lavekar ....Appellant V/s.
State of Maharashtra and Anr.
....Respondents __________________________________________________________ Mr. Nilesh Navale, for the Appellant.
Ms. Rashmi Tendulkar, APP for the Respondent-State. Mr. Rajendrakumar Rajmane, SDPO, Chiplun Dist. Ratnagiri. ___________________________________________________________ CORAM : SANDEEP V. MARNE, J.
Date :
12 SEPTEMBER 2024.
P.C. :
1) The learned counsel appearing for the Appellant, on instructions seeks leave to withdraw the Appeal with liberty to surrender before the Investigating Officer. He would request that after the Appellant files application for regular bail, the Trial Court be directed to decide the application for regular bail on the same day. It would not be appropriate for this Court to direct the Trial Court to decide the bail application on a particular day. At the same time, I do not see any reason why the application for regular bail, as and when filed by the Appellant, would not be taken up for expeditious decision. Appellant would be at liberty to request the Trial Court to decide the bail application expeditiously. Appeal is permitted to be withdrawn and disposed of.
