Learned APP has tendered an affidavit-in-reply of Suryakant Yewale, Tahasildar Pune City, Dist. Pune, dated 19th July 2024. The said affidavit-in-reply is taken on record. In the said affidavit, in para 3, it is stated as under :- "3.

I say that, I have gone through the order dated 15.07.2024 and in view of the same I am filing this Affidavit. I say that, the concerned Talathi and Circle Officer visited the subject property i.e. final plot no.881-A, area, 774.62 sq. mtrs. On 12/07/2024 and removed the temporary shades upon the said plot, temporary erected Bathroom, and construction material etc have been removed from the Government property.

21-2-2024-CONP=.doc Apart from the aforesaid, display of the notice board of name of respondent no.2 also removed from the subject property at village Bhamburda, Pune. As on today there is no any encroachment upon the subject land. The respondent will fence the property in question within four weeks. Hereto annexed and marked as Exhibit R-1 is the copy of spot inspection report along with the photographs."

Learned APP, on instructions, states that the property in question will be fenced as stated in the affidavit within 4 weeks from today. Statement is accepted.

The said fencing is to be carried out after measuring the land in question, which will be done in the presence of one of the representative of the petitioner.
