We have gone through the petition. It appears that respondent No.2 vide communication dated 29/06/2023 addressed to respondent No.3 (Annexure-VII to the petition) highlighted the alleged fraud committed by the petitionerSociety which runs into crores of rupees and requested the respondent No.3 to lodge a formal complaint under Sections 3 and 4 of the MPID Act read with relevant Sections of IPC, MSCS Act, 2002 to set the law in motion, to take legal action to protect the interest of the depositors and take steps to dissolve the present body running the Society and appoint an administrator to run the affairs of the Society.

The letter indicates that urgent action is warranted as there is likelihood of Society getting bankrupt, resulting loss to the depositors.

We are informed that no action has been taken by respondent No.3.

Counsel for respondent No.3 shall take instructions as to whether respondent No.3 has taken cognizance of this communication and further about the action taken if any. 8.

For the time being, keep the matter at 2.30 p.m., thereafter we may grant leave to the respondent No.3's counsel to file a detailed reply.

Except for vague statements, the counsel for respondent No.3 could not give us any satisfactory answer as to what steps respondent No.3 had taken pursuant to the letter received from the Commissioner of Police, Nagpur.
