The order dated 18.01.2023 passed by the learned Additional Sessions Judge, Pusad below Exhibit-2 in Criminal Appeal No.4/2023 directing respondent to deposit 10% of the compensation amount while suspending substantive sentence is under challenge.

The petitioner contended that as per section 148 of the Negotiable Instruments Act, 1881 the appellate Court to pass order of directing the appellant to deposit minimum 20% of the compensation amount while suspending the sentence passed by the trial Court. Whereas, in the case in hand, the direction to deposit only 10% of the compensation amount is given.
