The petitioner lady is seeking writ of habeas corpus alleging that respondent Nos.3 to 5 have kept her child in illegal detention.

After the demise of petitioner's husband, within one month i.e. on 26.11.2022 she delivered a male baby. At the relevant time, she was living with her parents-in-law i.e. respondent Nos.3 to 5. The petitioner claims that she has been driven away from her matrimonial house but child was snatched from her. It is submitted that since last seven to eight months, the child is with respondent Nos.3 to 5. Since the child is barely one and half years of the age, the child needs care and custody of mother. According to the petitioner, respondent Nos.3 to 5 have illegally detained the child.

Issue notice to the respondent Nos.3 to 5, returnable on 15.04.2024.
