01] On the oral request of the learned Counsel for the petitioners, permission is granted to amend the prayer clause of the petition. 02] Amendments be carried out forthwith.
03] The petition challenges the impugned order dated 23/11/2023 passed by the learned Chief Judicial Magistrate, Nagpur, whereby process has been issued against the petitioners for the offence punishable under Sections 406, 420, 466, 468, 471 r/w 34 of Indian Penal Code in R.C.C. No.3662/2013.
04] On the complaint of respondent No.2, initially the learned Magistrate directed the police to conduct enquiry under Section 202 of Cr.P.C. Pursuant to which, a report came to be filed by the police authority with observation that no concrete proof was found to the allegations made by the complainant. The contention is that in spite of report of the Police, the learned Magistrate issued process against the petitioners for the aforesaid offences.
