The petition seeks quashing of Essential Commodities Case No.11 of 2019, pending before the learned Sessions Judge, Gadchiroli.

The contention is that the Seed Inspector and Extension Officer (Agriculture), Panchayat Samiti, Aheri, has not followed the proper procedure in drawing the sample and there is no compliance of mandatory provisions. It is also contended that the sample has not been left with the person from whom sample has been collected for getting it tested. The petitioner company himself got the seed tested and contrary finding is given.

Issue notice to the respondent, returnable within two weeks. Mr Umale, learned APP, waives notice on behalf of respondent/State.

The Trial Court shall not insist the presence of the petitioner on the next date of hearing.
