Heard the learned advocates for the parties. Perused the record and proceedings.

In this petition, challenge is only to clause (4) of the order dated 22nd January, 2024, passed by the learned Judicial Magistrate First Class, Sakoli. The learned Additional Sessions Judge, Bhandara, in the revision filed by the petitioner, was pleased to confirm this order.

As per clause (4) of the order passed by the learned Magistrate, the petitioner has been directed to execute a bond of Rs.2,00,000/- (Rs. Two Lakhs) immediately by way of a bank guarantee or by depositing the said amount in the Court. It is submitted that the petitioner is ready to furnish the solvent surety. It is seen that the purpose would be served by modifying this condition. Accordingly, the condition is modified as follows:

-2- 2B.WP.318.2024.odt i] Instead of bank guarantee of a sum of Rs.2,00,000/- (Rs. Two Lakhs), the petitioner shall execute a solvent surety in the like amount.

ii] The petitioner, before getting custody of the vehicle, shall comply the remaining part of the order in letter and spirit. 4.

The petition stands disposed of accordingly.
