By the present application, respondent No.4 seeks cancellation of non bailable warrant issued against him. The non bailable warrant was issued because none appeared for respondent No.4 and considering the previous conduct as reflected in previous orders.

Today, respondent No.4 is present. Counsel for respondent No.4 submits that he and respondent No.4 could not appear because both were busy in filing affidavit. 3.
The excuse that both counsel and his client were busy for the entire day in filing affidavit is a lame excuse that is given for their absence. Nonetheless, the counsel and respondent No.4 submits that they will diligently attend the proceeding. 4.
In view of such assurance, non bailable warrant issued on 10.11.2025 stands cancelled, subject to costs of Rs.5,000/- to be paid by respondent No.4 to petitioner, within 15 days from today.

The application is disposed of.
