Today, we have interacted with the child aged 8 years in our chamber, who is brought in the Court by the father.

We have tried to understand the wish and will of the father. Since the matter is subjudice, we are not expressing anything on that issue at the moment. The issue is delicate pertaining to the custody of the child may have come before us under the Petition seeking writ of Habeas Corpus.

It is learnt that no matrimonial proceedings is pending between the husband and wife except an order of maintenance. Admittedly, the marriage is still in subsistence. Thus, we have suggested both the learned Counsel that the entire issue could be resolved by way of mediation. Both the learned Counsel readily agreed on our suggestion.

In view of the above, the matter is referred for mediation to Advocate Shri S.Y. Deopujari. Both parties along with the child shall appear before the learned

The learned Mediator shall submit the report within one week from the appearance of the parties. 6.

Stand over to four weeks.
