The petition challenges the order dated 24.04.2023 below Exhibit - 6, passed by the learned Judicial Magistrate First Class, Wardha, in R.C.C. No.448 of 2019, thereby rejecting the application of the petitioner for discharge. The petition also lays challenge to the order dated 29.12.2023 passed by the learned Additional Sessions Judge, Wardha, thereby rejecting the criminal revision application preferred by the petitioner. 3.
The contention is that the petitioner is Talathi and as per the order of Nayab Tahsildar, who is accused No.4, mutated the entry of status of land as non-agriculture in revenue record. The further contention is that the petitioner has acted as per the order of Nayab Tahsildar, therefore, he has not committed any offence, but this aspect has not been considered by the Courts below.
