This is an application seeking to quash charge-sheet arising out of Crime No.73/2023 registered with Police Station Juni Kamptee, District - Nagpur, for the offence punishable under Sections 353, 294, 323, 504, 506 read with Section 34 of the Indian Penal Code and Section 85 of the Maharashtra Prohibition Act.

Learned APP would submit that the applicants have made personal allegations against some of the Police Officers and urged for taking Prity

2 / 2 6.wp371.2024 action against them. In the situation, learned APP requested to direct the applicant to make those Police Officers as a party.

Per contra, learned counsel for the applicant would submit that he has made Superintendent of Police as a party seeking directions to conduct an enquiry. According to him, those Police Officers are not necessary parties. 5.

The concerned Police are directed to preserve relevant CCTV footage and produce it as and when called.

Issue notice to the non-applicants, returnable on 03.07.2024.

Mr. Joshi, learned APP waives service of notice on behalf of non-applicants/State.
