Learned Advocate for the petitioner seeks leave to withdraw the petition with liberty to make fresh application before the competent authority for regular parole in terms of Rule 19 sub rule (3) of the Maharashtra Prisons (Mumbai Furlough and Parole) Rules, 1959 (for short 'the Rules of 1959').

Petition stands disposed of, as withdrawn, with liberty as prayed for.

The prayer to withdraw the petition has been made considering the fact that parole earlier granted was Special Parole under sub-rule 2 of Rule 19 of the Rules of 1959. It

2 1 cr. wp 457.24.odt. needs to be stated that there are three kinds of parole. The convict is entitled to emergency parole, special parole and regular parole. Rule 3 clause (C) sub-clause (ii) of the Rules of 1959 provides for a bar in case of regular parole. 5.

The competent authority is requested to decide the application for regular parole, as and when made, expeditiously and in any case within a period of 15 days from the date of application.
