The petitioner is challenging the order passed by the Deputy Inspector General of Prison, Eastern Region, Nagpur imposing penalty of late surrender. It is submitted that the penalty is too excessive and disproportionate.

The learned Counsel appearing for the petitioner submits that the first late surrender of 88 days was in the year 2011, whilst the second late Rgd.

Order 2110wp470.24 surrender of 56 days was in the year 2014. It is submitted that on both occasions, the petitioner has surrendered on his own.

According to the petitioner, the reason for late surrender has not been considered. It is submitted that after 2014 till date, the petitioner has availed parole and furlough leave, but, on each occasion he has surrendered on due date.

Learned A.P.P. to take instructions whether after 2014 till date, there was late surrender on any occasion. If so, specify the same in a tabular form.

List the matter for further consideration on 20.11.2024.
