Heard learned advocate for the petitioners. Perused the record and proceedings.

It is seen on perusal of the record that condition No.5 cannot be completely relaxed. However, in order to take care of their principal grievance that they have not been able to cultivate their land, this condition can be appropriately modified. The condition is modified as follows: i.

Petitioner Nos.1 and 2 shall not enter village Khapri Kene, Tahsil Katol, Dist. Nagpur, till conclusion of the trial. 3.

If this modification is made, then it would take care of their principal grievance.

The petition stands disposed of accordingly.
