Learned Public Prosecutor has firstly submitted that the petitioner has no locus and secondly this petition would lie to the Division Bench dealing with civil writ petitions. It is submitted that though a notification is issued under the Code of Criminal Procedure but State in its exercise of administrative power has issued notification and thus it has no repercussions like attracting any punishment or forfeiture. 3.
Reliance is placed on the decision of this Court in case of M/s. Nagpur Cable Operators' Association V/s. Commissioner of Police, Nagpur and another reported in 1995(2) Mh.L.J. 753 to substantiate the said stand. 4.
The petitioner is absent. He shall appear and satisfy on 3.9.2024, failing which the matter shall be proceeded further in his absence, in accordance with law. 5.
Stand over to 3.9.2024.
