Learned APP waives the notice for respondent No.1. 2.

Considering the issue involved in the matter, notice is not necessary to respondent No.2.

Learned advocate for the petitioner submits that, on account of the financial difficulties of the petitioner, he could not deposit the 20% amount in one go in terms of the order dated 29th February, 2024. The record shows that he has so far deposited Rs.13,000/-. It is submitted that he is ready to deposit the balance amount in terms of the order dated 29th February, 2024.

The learned Judge, vide order dated 13th June, 2024, has rejected his application, seeking permission to deposit the remaining amount in terms of the order dated 29th February, 2024. In view of the statement made by the petitioner that he is now ready to deposit the balance amount, it would be in the interest of justice to grant him the opportunity.

In view of this, the petition is allowed.

The order dated 13th June, 2024, rejecting his prayer to deposit the amount in compliance with the order dated 29th February, 2024, is set aside.

The petitioner shall deposit the amount without fail on or before 29th August, 2024.

The petition stands disposed of in the aforesaid terms. No order as to costs.
