Both petitioners are similarly seeking to quash First Information Report vide Crime No. 387/2024 registered with Police Station Kalmeshwar, Nagpur for the offence punishable under Section 306 read with Section 34 of the Indian Penal Code.

The informant is nephew of deceased Krushipalsingh who was serving as driver. On 25.05.2024 Krushipalsingh has committed suicide by hanging. It is informant's contention that while checking belonging of deceased, he found some cheats wherein it is alleged that both petitioners who are the employer, did not pay dues and therefore, deceased by blaming both of them, has committed

2 901 wp 691.24 suicide. It is petitioners' contention that alleged act does not constitute the offence of abetment to commit suicide. 4.

Issue notice to the respondents returnable after six weeks. The learned APP waives service of notice for respondent No.1.

In the meantime, investigation may go on, but charge-sheet shall not be filed without obtaining leave of this Court.
