The Special Inspector General of Police (Prison), Eastern Region, Nagpur, who has passed the impugned order, has filed an affidavit tendering an unconditional apology for mentioning incorrect reasons for the rejection of the prayer for furlough. 2.

It is a fact that the petitioner in 2009 surrendered late, however, subsequent thereto, after his release on furlough/parole, the conduct was found to be above-board.

The apology tendered by the Special Inspector General of Police (Prison), Eastern Region, Nagpur is taken on record.

The order impugned, for the aforesaid reasons, is quashed and set aside with direction to admit the petitioner to furlough on reasonable terms and conditions. 5.

The petition stands disposed of accordingly.
