Heard learned advocate for the petitioner and learned APP for the respondent/State.

It is seen on perusal of the record that the vehicle in question was given in custody of the petitioner by the original owner pursuant to the Hire agreement dated 05.02.2024. The copy of the agreement is on record. The agreement was valid up to 05.01.2025. The period of the agreement has come to an end. The petitioner is not the owner of the vehicle. It is apparent that now the owner must be an interest and proper person to get custody of the vehicle.

In view of this, the learned advocate for the petitioner seeks leave to withdraw the petition with liberty to make a fresh application through the owner of the vehicle for the custody of the vehicle. The petition stands disposed of as withdrawn with liberty as prayed for.

As and when an application is made by the owner for return of the vehicle, it must be disposed of in accordance with law.
