The petitioner has approached this Court with a prayer to direct respondent Nos.2 and 3 to lodge FIR against the persons, who were responsible for playing fraud upon the petitioner and his daughter.

Learned APP submits that FIR was lodged, investigation carried out, and charge-sheet filed. He further submits that a supplementary charge-sheet has been also filed. He submits that out of six accused, charge-sheet has been filed against five, of whom four were arrested and one is absconding. Efforts are being made to arrest him as well. He further submits that out of the four arrested accused, three have been released on bail and one is still in jail. 3.

The counsel for the petitioner submits that investigation has been not carried out properly. If that be so, he may pursue the cause before the Trial Court under Section

38.WP.745.2024.odt 2/2 193(9) of the Bharatiya Nagarik Suraksha Sanhita, 2023 [Section 173(8) of the Code of Criminal Procedure, 1973]. 4.

With the aforesaid liberty, the petition is disposed of.
