We have heard Mr. Dharmadhikari, learned Advocate appearing for the petitioner.

He has invited our attention to the application moved under Section 340 of the Code of Criminal Procedure by defendant No.12 in Special Civil Suit No.31/2019 wherein the enquiry and prosecution has been sought against defendant Nos.1, 4, 8 to 10 and their Advocates. According to him, another application is moved by the very same defendant seeking reference of Vakalatnama (Exh.47) of defendant No.12 for the opinion of the Handwriting Expert. 3.

It is claimed that the applications are pending since long and not yet decided.

We have perused these applications. The Court has already called say of the other side.

In this background, we grant liberty to the petitioner to go before the Court for expeditious disposal of these applications. In case if such proceedings are taken, we expect the civil Court to deal

wp826.2024.odt with the prayer of the petitioner for expeditious disposal, at the earliest.
