The present petition under Articles 226 and 227 of the Constitution of India challenges the order dated 05.10.2024 wherein, the application filed by the petitioner for compounding of offence is rejected by the Additional Sessions Judge, Wardha in Criminal Appeal No.10/2022. The proceedings arising out of Section 138 of the Negotiable Instruments Act, 1881.

Learned counsel appearing for the petitioner filed an undertaking before this Court saying that a settlement is arrived today between the petitioner and respondent-Shri Atul Pillewar and therefore, he submits that he undertakes to pay Rs.6,00,000/- (Rupees Six Lakhs Only) towards full and final settlement as dispute is arising out of dishonour of cheque. He further states in the said undertaking that the settlement amount would be paid within a period of three months from today in three equal installments of Rs.2,00,000/- (Rupees Two
2 18-.odt Lakhs Only) each to be paid on or before 04.01.2026, 04.02.2026 and 04.03.2026 directly in the account of the respondent.

The learned counsel submits that he received the bank account number of respondent and the same was supplied to petitioner who is present in the Court. 4.
Upon interaction with petitioner, he confirms that whatever is stated in undertaking he would abide by the same.

Undertaking filed by the petitioner is taken on record and the same is marked as 'X' for identification purpose.

On the basis of the undertaking, this Court accepts the settlement between the parties. Needless to mention that the Appellate Court shall not proceed with the Appeal No.10/2022 till 10.03.2026. In case the entire amount is paid by the petitioner till 04.03.2026 under such circumstances appropriate order may be passed by the Appellate Court.

In this view of the matter, the present petition is disposed of.
