The order of externment passed by the Sub-Divisional Officer, who has neither filed reply till this date nor has issued instructions nor contacted with the Office of Public Prosecutor. 2.

The issue is informed to be covered by the Division Bench Judgment in the matter of Kamalkishor s/o. Pusaram Bang Vs. The Superintendent of Police, Jalna and two others, delivered in Criminal Writ Petition No.239/2018 on 12th April, 2018 by Aurangabad Bench of this Court.

Considering the fact that the respondents should have submitted their response or requested the Office of the Public Prosecutor to seek adjournment in the matter, which they have failed.

We saddle costs of Rs.5,000/- to be recovered from the Sub-Divisional Officer, Saoner to be deposited with the Legal Services Authority, Saoner. Acknowledgment of which be placed on record.
