The counsel for the petitioner so as to substantiate his contention that the externment order cannot be based on the offences punishable under the provisions of the Maharashtra Prevention of Gambling Act or the Maharashtra Prohibition Act, has relied on the judgment dated 03/09/2013 in Criminal Writ Petition No.355/2013 (Sagarsingh Kesharsingh Bawari vs. Ministry of Home Department, Mantralaya, Mumbai and ors.) which is followed in Criminal Writ Petition No.0239/2018 (Kamalkishor s/o Pursaram Bang vs. The Superintendent of Police, Jalna and ors.) decided on 12/04/2018. However, both these judgments do not elaborate on the point as to the reason for not accepting such offences for justifying the order of externment.
