Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.333 of 2023 registered with Pimpalner Police Station, District Dhule for the offence punishable under Sections 302, 506 of the Indian Penal Code. 3.

The prosecution case is based upon the oral statement as to the cause of death made to his son by the deceased when he was under treatment. Considering the statement of the deceased made to his son, it seems that the incident happened in the fit of anger when the deceased went to demand money to the applicant. These circumstances are to be considered from the point, what was the intention of the deceased. There are no antecedents to the discredit of the applicant. The investigation has been completed. Nothing is to be recovered from him. No purpose would be served by keeping the

937-ba-955-2024.odt (2) applicant behind bar. For the above reasons, the applicant deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Rajendra @ Sikan Sonay Pawar, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses till the conclusion of the trial.

(b) The applicant shall stay away from his village for three months from the date of his release.
