Heard the learned counsel for the applicant and the learned A.P.P. for the respondents.

The applicant seeks bail in C.R.No.0243 of 2024 registered with Police Station Kotwali, Parbhani, District Parbhani, for the offences punishable under Sections 406, 409, 420, 120B of the Indian Penal Code and Section 3 and 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

The applicant was a Clerk in the Multistate Society. The allegations against him were that he went to the house of the first informant with Manager and on the say of the Manager, the complainant deposited a huge amount. Further allegations against him that he was disseminating the schemes of the society for convincing the depositors. He was knowing well that the institution

926-BA-1567-24.odt could not return benefits as promised. The learned A.P.P. submits he has played active role.

The papers reveal that he being an employee was duty bound to convince the people for depositing more and more money with the institution. He did not seem to be involved in the fraud. He was barely a clerk in the society. The material investigation has been completed against him. In the circumstances, his detention would serve no purpose. Hence, he deserve bail.

ORDER

i) The bail application is allowed.

ii) Applicant - Vilas Parmeshwar Warkad be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should attend the Police Station as and when called by the Investigating Officer on written notice till filing the chargesheet.
