Heard the learned counsel for the applicants and the learned APP for the respondents-State in both the applications. 2.
The applicants have approached this Court apprehending arrest in connection with Crime No. 934/2023 dated 6.12.2023 registered with Hingoli City Police Station, District Hingoli for the offences punishable under sections 120-B, 408, 409, 420 of IPC and u/s. 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999. 3.
This Court by order dated 13.2.2024 has granted interim protection to the applicant - Shirish Kantarao Jahangirdar in ABA No. 238/2024, so also by order dated 9.2.2024 granted interim protection to the applicant -
Akshay Santosh Niljewar in ABA No. 206/2024. The learned counsel for the applicants relying upon the order passed by this Court dated 26.3.2025 in ABA No. 265/2024 and other connected matters in the same crime submits that the applicants in those matters have been granted anticipatory bail. The learned counsel for the applicants submits that applicant - Shirish Kantarao Jahangirdar in ABA No. 238/2024 is the Passing Officer and the applicant - Akshay Santosh Niljewar in ABA No. 206/2024 is the Cashier. The learned counsel for the applicants submit that the above applicants had no connection whatsoever with Khajuriya Family and they are not related or connected with Khajuriya Family. The learned counsel submits that in view of the order dated 26.3.2025 passed in ABA No. 265/2024 and other connected matters in favour of the directors, interim protection granted to the applicants in present matter be confirmed as their role is lessor then to the applicants in ABA No. 265/2024 and other connected matters. 4.
The learned APP has not been able to controvert this position. The applicants in present applications are not related with Khajuriya Family and their role in the matter is lessor then the role of applicants in ABA No. 265/2024 and other connected matters. Considering this aspect of the matters, interim protection granted to the applicant - Shirish Kantarao Jahangirdar in ABA No. 238/2024 by order dated 13.2.2024 and interim protected granted to the applicant - Akshay Santosh Niljewar in ABA No. 206/2024 by order dated 9.2.2024 can be confirmed. 5.
In view of the above, the applications are allowed and the interim protection granted to the applicant - Shirish Kantarao Jahangirdar by order dated 13.2.2024 in ABA No. 238/2024 and interim protected granted to the applicant - Akshay Santosh Niljewar in ABA No. 206/2024 by order dated
9.2.2024 is confirmed on the following terms : i] The applicants shall attend the police station as and when required.
ii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited for the purpose of disposal of the present anticipatory bail applications and the trial Court shall not be influenced by the observations made hereinabove.

The applications stands disposed of.
