Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0008/2024, dated 09/01/2024, registered at Azadnagar Police Station, District Dhule, for the offences punishable under sections 379 of the Indian Penal Code.

This Court, by order dated 14/02/2024, granted anticipatory bail to the applicant. The allegations in the FIR, which was registered in January 2024, pertain to the theft of the informant's SIM card in the year 2016. Considering the same, this Court granted interim protection. 4.
The learned APP submits that the said SIM card was used by the father of the applicant to threaten witness in some other case registered against him, leading to the registration of the present FIR. It is further 1 of
975 ABA 246-2024 submitted that the applicant has not co-operated with the investigation. While the SIM card was allegedly used by the applicant's father, there remains a doubt as to why the SIM is not blocked. 5.
Considering the totality of circumstances, including the fact that the SIM card was not used by the applicant, the possibility of its theft eight years ago being remote, and the fact that the applicant is a lady, prima facie this is a fit case to confirm the interim protection granted by order dated 14/02/2024.

In view of the above, the application is allowed in the following terms :- i] In the event the applicant is arrested in connection with FIR No.0008/2024, dated 09/01/2024, registered at Azadnagar Police Station, District Dhule, for the offences punishable under sections 379 of the Indian Penal Code, she shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. She shall not influence the informant, 2 of
975 ABA 246-2024 witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 7.
In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 9.
The application stands disposed of.
