CORAM :

ADVAIT M. SETHNA, J.

DATE :

25 JULY, 2025 P.C.:- 1.

Heard learned counsel for the respective parties for some time.

2.

At the very outset, my attention is drawn to the order dated 12.11.2024 by which the Applicant was protected. This protection was extended from time to time. Mr. Lavte would not controvert this position.

3.

Today, during the hearing of the matter, Mr. Lavte has taken specific instructions. He would submit that huge amounts to the extent of about Rs.25,00,000/- have been credited to the personal account of this Applicant to which, there is no explanation. To the contrary, Mr. Gangakhedkar would submit that he has filed an additional Affidavit dated 25.03.2025 in these proceedings of the Applicant. Several documents explaining these transactions have been annexed to the said

2 of 3 909-ABA.1354.2024 Affidavit. More importantly, he would draw the Court's attention to the resolution dated 10.08.2022 passed by the Rajasthani Multi State Cooperative Credit Society Limited, which was for the limited purpose of executing an agreement for the opening of the new branch. He would also draw the Court's attention to various invoices which he has placed on record. According to him, these invoices would corroborate the fact that the amount that has been credited to his account would correspond to these invoices. Mr. Lavte would further take appropriate instructions in this regard. Also, it is pertinent to note that as pointed out by Mr.

Gangakhedkar that there are no amounts which are recoverable from this present Applicant by the said Rajasthani Multi State Co-operative Credit Society Limited, which would be apparent from the statement dated 15.02.2024, which is also a part of this additional Affidavit filed by the Applicant. To enable Mr. Lavte to take appropriate instructions with regard to the invoices and the amounts which have been credited to his account, list this matter for further consideration on 08.08.2025, "High on Board". 4.

Until then, protection granted by order dated 12.11.2024 shall continue to operate in favour of the Applicant. 5.

It is to be noted that this Court has granted anticipatory bail in A.B.A. No.9 of 2025 to one Mr. Venkatesh Bapurao Kulkarni, who is

3 of 3 909-ABA.1354.2024 the CEO of Rajasthani Multi State Co-operative Credit Society Limited and that the Chairman of the co-operative society is in judicial custody, as submitted across the Bar.
