BENCH AT AURANGABAD 906 ANTICIPATORY BAIL APPLICATION NO. 1714 OF 2024 Sambhaji Sitaram Bhalekar

VERSUS

The State Of Maharashtra ......

Mr. Piyush Toshniwal, Advocate (through V.C.) for Applicant Ms. P.V. Diggikar, APP for Respondent - State ......

CORAM : HITEN S. VENEGAVKAR, J.

DATE : 30 SEPTEMBER, 2025 PER COURT :- 1.

The learned APP submits that the applicant was granted interim relief by this Court vide order dated 11.10.2024 in which he was directed to attend the Police Station once in a week. He has instructions from the Investigating Officer stating that the applicant after securing the interim relief from this Court, has not attended the Police Station and thus violated the conditions imposed by him while granting interim relief. She further submits that during the pendency of this application one more crime under the MPID Act came to be registered. In the said offence as well, he is not co-operating with the investigating agency and his whereabouts are not traceable.

2.

The learned Advocate for the applicant, on instructions, fairly admits that subsequent to registration of the new FIR, the applicant had

906-ABA-1714-24.odt {2} approached the Sessions Court, seeking anticipatory bail in the new FIR, however, the learned Sessions Court has rejected the said anticipatory bail and the same was rejected around six months back. Admittedly, no application seeking anticipatory bail has been filed in this Court. He prays that one chance may be given to the applicant to attend the Police Station and comply with the order of this Court. 3.

Having considered the aforesaid submissions, the applicant is directed to appear before the Investigating Officer on 06.10.2025 at 01.00 p.m. in the present crime, i.e., C.R. No. 245 of 2024. If the applicant fails to appear on the said date, the interim relief granted in favour of the applicant shall stands vacated with effect from 07.10.2025.

4.

List this application for hearing on merits on 04.11.2025. [ HITEN S. VENEGAVKAR ] JUDGE S P Rane
