Issue notice to respondent returnable on 11/11/2024. Learned APP waives service of notice on behalf of the Respondent/State.

Learned counsel for applicant submits that, applicant is the Chief Executive Officer of Raje Shivaji Gramin Bigarsheti
(2) Sahakari Patsanstha, Kanhur Pathar, Tq. Parner, Dist. Ahmednagar. It is contention of learned counsel for applicant that the subject loan was neither sanctioned by the applicant nor the documents therein have been verified by him. It is his contention that the said loan was applied and sanctioned at Parner Branch and that the applicant has no concern with the same. He further makes statement that after the present applicant in the capacity of the Chief Executive Officer has issued pay order in favour of the said Branch in turn to pay the said amount to the applicant. It is his submission that co-accused, who was alleged to beneficiary of crime has been granted anticipatory bail by the same Court, which was rejected application filed by present applicant. 5.
Having regard to the aforesaid facts, till the prosecution is heard in the matter, liberty of applicant is protected. Hence, the following order :-
ORDER
(i) Till next date, in the event of arrest of applicant in connection with Crime No.245 of 2024 , registered with Parner Police Station, Dist. Ahmednagar, for the offences punishable under
(3) Sections 409, 420, 468, 471, 477-A read with Section 34 of the Indian Penal Code, 1860 and under Section 39 of the Maharashtra Money Lenders (Regulation) Act, 2014, he be released on bail on furnishing PR Bond of Rs. 15,000/- (Rs. Fifteen Thousand only) with one surety in the like amount.
(ii) He shall attend the concerned police station once in a week.
(iii) He shall not contact the witnesses directly or indirectly.
(iv) He shall not interfere with the evidence in any manner whatsoever.
(v) He is further directed to cooperate the investigating agency for further investigation. (vi) Learned APP to communicate this order to the concerned Investigating Officer.
