Issue notice to respondent returnable on 11/11/2024. Learned APP waives service of notice on behalf of the Respondents/State.

Learned counsel for applicant submits that, though name of applicant is mentioned in the first information report, he invited attention of this Court to the partnership deed between coaccused Deepaksing Babusing Chavan and Mohan Rustum Maghade. It is his submission that applicant is nothing to do with
(2) the partnership deed between the co-accused. He also invited attention of this Court to the order passed by the Additional Sessions Judge, rejecting application for anticipatory bail, wherein there is no observation made with regard to any money having been received by the present applicant in this crime. It is his contention that the applicant is the brother of co-accused, who has now has been included in order to pressurize him for returning of the money of the investors.

Having regard to the aforesaid facts, till the prosecution is heard in the matter, liberty of applicant is protected. Hence, the following order :-
ORDER
(i) Till next date, in the event of arrest of applicant in connection with Crime No.0844 of 2024, registered with M.I.D.C. Waluj Police Station, Dist. Aurangabad, for the offences punishable under Sections 406, 409, 420 read with Section 34 of the Indian Penal Code, he be released on bail on furnishing PR Bond of Rs. 15,000/- (Rs. Fifteen Thousand only) with one surety in the like amount.
(3) (ii) He shall attend the concerned police station once in a week.
(iii) He shall not contact the witnesses directly or indirectly.
(iv) He shall not interfere with the evidence in any manner whatsoever.
(v) He is further directed to cooperate the investigating agency for further investigation. (vi) Learned APP to communicate this order to the concerned Investigating Officer.
