Issue notice to respondents, returnable on 22/11/2024. Learned APP waives service of notice on behalf of the respondents/ State.

Learned counsel for applicants submits that in view of the reason that applicants are maternal uncles of one of the co-accused, they have sought to be involved in this crime. On

(2) instructions, he makes a solemn statement that applicants have not signed any document acknowledging acceptance of any money from the investors and that they are not concerned with the alleged investment. These statements are accepted. If these statements are found incorrect, the same shall be the reason for rejection of application. Apart from this, prima facie, perusal of the order passed by the learned Additional Sessions Judge does not indicates any evidence laid before it, indicating involvement of the applicants in the crime.

Having regard to the aforesaid facts, liberty of these applicants is protected, till the prosecution is heard in the matter. Hence, the following order :-

ORDER

(i) Till next date, in the event of arrest of these applicants in connection with Crime No.0730 of 2024, registered with Shevgaon Police Station, Dist. Ahmednagar, for the offences punishable under Sections 420, 406, 409, 120-B read with Section 34 of the Indian Penal Code and under Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999, they be

(3) released on bail on furnishing PR Bond of Rs. 15,000/- (Rs. Fifteen Thousand only) each, with one surety in the like amount.

(ii) They shall attend the concerned police station once in a week.

(iii) They shall not contact the witnesses directly or indirectly.

(iv) They shall not interfere with the evidence in any manner whatsoever.

(v) They are further directed to cooperate the investigating agency for further investigation. (vi) Learned APP to communicate this order to the concerned Investigating Officer.
