Issue notice to Respondents, returnable on 11/11/2024. Learned APP waives service of notice on behalf of both the Respondents.

Learned counsel for applicant submits that co-accused against whom same allegations are made, as made against present applicant, is protected by the order of this Court dated 11/10/2024, passed in Anticipatory Bail Application No.1727/2024. He, therefore, seeks similar protection to present applicant on the ground of parity, till prosecution is heard in the matter.

Learned APP opposed grant of any interim relief. However, at this stage, he is not able to show any evidence, which distinguishes role of present applicant and co-accused, who has granted interim protection.

Having regard to the aforesaid facts, till prosecution is heard in the matter, liberty of applicant is protected. Hence, the following order :-
ORDER
(i) Till next date, in the event of arrest of applicant in connection with Crime No. 0844/2024, registered with M.I.D.C. Waluj Police Station, District Aurangabad, for the offences punishable under Sections 406, 409, 420 read with Section 34 of the Indian Penal Code, he be released on bail on furnishing PR Bond of Rs. 15,000/- (Rs. Fifteen Thousand only) with one surety in the like amount. (ii) He shall attend the concerned police station once in a week.
(iii) He shall not contact the witnesses directly or indirectly.
- 3 - (iv) He shall not interfere with the evidence in any manner whatsoever.
(v) He is further directed to cooperate the investigating agency for further investigation. (vi) Learned APP to communicate this order to the concerned Investigating Officer.
