1] Tag ABA/37/2025 with ABA/1916/2024.
2] In ABA/37/2025, heard learned counsel for the applicants and the learned APP for the respondent-State. 3] In ABA/37/2025, the applicant has approached
this Court apprehending arrest in connection with Crime No.0120/2024, dated 05.04.2024, registered with Beed (Rural) Police Station, District Beed, for the offences punishable under sections 307, 326, 324, 323, 341, 120-B, 143, 147, 148, 149, 504, 506 of IPC.
4] This court by an interim order dated 28.10.2024, in ABA Stamp No.12190 of 2024 (ABA/1916/2024) has protected Ganesh and Namdo. The learned counsel for the applicants submits that the role of the applicant in ABA/37/2025, so also, Ganesh and Namdo is identical as pointed out from page no.19 of the application.
5] Considering the same, in ABA/37/2025, issue notice to the respondents. The learned APP waives service of notice on behalf of respondents / State Authorities. 6] In ABA/37/2025, in the meanwhile, there shall be interim order in the following terms :- A] Till the next date, in the event the applicant is arrested in connection with Crime No.0120/2024, dated 05.04.2024, registered with Beed (Rural) Police Station, District Beed, for the offences punishable under sections 307, 326, 324, 323, 341, 120-B, 143, 147, 148, 149, 504, 506 of IPC, they shall be released
on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount.
B] The applicant shall remain present before the investigating officer from 15.01.2025 till 17.01.2025 from 10:30 a.m. to 01:30 p.m.
C] The applicant shall co-operate with the investigation, including producing all documents in their possession, as may be demanded by the investigating officer.
D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.
7] Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled. 8] List on 20.01.2025.
