As far as this Applicant is concerned, it may be noted that the alleged incident the same as that in Anticipatory Bail Application No. 1922 of 2024. It arises out of the same CR. The nature of injuries inflicted are also similar. The facts and circumstances are also similar. There is complete recovery of the alleged weapons of the spot. As far as this Applicant is concerned, Mr. Phule points out that this Applicant has used the iron inflicting the injury on the informant, who after hospitalization was discharged.

There is some delay in filing the said FIR which also needs to be considered. The aspect of counter blast from the earlier NC dated 28 September 2024 cannot also be overlooked in the peculiar facts and circumstances.

In this Application it is pointed out that the Applicant is a 903.aba1931.24.odt

teacher employed with the Dnyansagar Niwasi Karnabadhir Vidyalaya, Ambajogai, Dist. Beed having no criminal antecedents. Thus, in my view the end of justice would meet by passing the following order.

ORDER

(i) In the event of arrest of the Applicant in connection with C.R. No. 266/2024 registered with Washi Police Station, Dist. Osmanabad for the offences punishable under Sections 118(1), 118(2), 126(2), 115(2), 352, 351(2) read with 3(5) of the BNS, the applicant is directed to be released on bail on their furnishing PR bond in the sum of Rs. 20,000 (Rupees Twenty Thousand Only) with one solvent sureties in the like amount.

(ii) The applicant shall cooperate with the investigation. He shall attend the concerned police station on every Sunday at 11.30 am until further order.

(iii) The applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately informed to the concerned police station.

(iv) The applicant shall not leave the jurisdiction of the Court without prior permission of the Court.

(v) He shall not interfere with the evidence and shall not tamper prosecution witnesses in any manner whatsoever. 4.

Needless to mention that these are prima facie observations made in adjudicating this ABA only.

The ABA is allowed in above terms.
