PER COURT :- 1.

Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant has approached this Court apprehending arrest in connection with FIR No.0433/2024, dated 05/09/2024, registered with Police Station Aundha Nagnath, District Hingoli, for the offences punishable under sections 109, 118(1), 118(2), 189(2), 189(4), 190, 191(1), 191(2), 191(3), 351(2), 351(3), 352 of the Bhartiya Nyaya Sanhita, 2023.

The learned Counsel for the applicant submits that the son of the present applicant has already lodged an FIR against the complainant and other co-accused at the same police station. It is further submitted that, as a counterblast to the said FIR, the informant in the present crime has filed a false complaint against the applicant and his family members. 4.

Issue notice to the respondent, returnable on 10/12/2024. The learned APP waives service of notice for respondent-State. 1 of

In the meanwhile, there shall be interim order in the following terms:- A] Till the next date, in the event the applicant is arrested in connection with FIR No.0433/2024, dated 05/09/2024, registered with Police Station Aundha Nagnath, District Hingoli, for the offences punishable under sections 109, 118(1), 118(2), 189(2), 189(4), 190, 191(1), 191(2), 191(3), 351(2), 351(3), 352 of the Bhartiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount.

B] The applicant shall remain present before the investigating officer from 03/12/2024 till 06/12/2024 in between 10.30 a.m. to 01.00 p.m. and thereafter as and when required by the investigating officer.

C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.

D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.
