Learned Counsel for the Applicant, placed reliance upon the decision of the Hon'ble Apex Court in the case of Celestium Financial Vs. A Gnanasekaran Etc., reported in 2025 SCC OnLine SC 1320, and submitted that in view of the observations of the Hon'ble Apex Court, the Complainant under 138 of the Negotiable Instruments Act, is a Victim, and therefore, the Appeal under Section 372 of Cr.P.C. is maintainable. He prayed for tagging the present matter alongwith Criminal Application (APPA) No. 270/2024 in Criminal Appeal (ST) No. 2096/2024 and Criminal Application (APPA) No. 1227/2024 in Criminal Appeal (ST) No. 10059/2024, as the similar issue is involved. 2.
