Appellant on conviction has been sentenced to suffer rigorous imprisonment for 10 years and to pay a fine of Rs.10,000/-. It is stated that on the date of the judgment, the accused has
2/3 been in jail. He filed the appeal within limitation. He has no relative who could look after this matter in his absence.

Learned Advocate submitted that since 10 years substantive sentence has been awarded, the appellant deserves an opportunity of adjudication of his appeal on merits.

Learned APP submitted that the Court may pass an appropriate order.

I have perused the application and reasons stated in the application. In my view, on the basis of the reasons stated in the application, the case has been made out for condonation of 91 days delay in filing appeal against the impugned judgment and order. According, delay is condoned. The appeal be registered.

The application stands disposed of, accordingly.
