This is an application for condonation of 833 days delay in filing the appeal against the judgment and order dated 7th December, 2020. The learned Judge, on conviction, has sentenced the accused to suffer rigorous imprisonment for 10 years for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 5.

The reasons have been stated in the application. Considering the facts and circumstances, the delay deserves to be condoned. Accordingly, it is condoned.

The application stands disposed of accordingly. CRIMINAL APPEAL ST. NO.

OF 2024 8.

Learned advocate for the appellant submits that accused No.2, in this case, had filed an appeal against the very same judgment and order. It is pointed out that this Court has allowed his appeal i.e. Criminal Appeal No.143/2023 and acquitted him vide judgment and order dated 06.01.2023. 9.

In view of this, learned advocate for the appellant shall pace the copy of the said judgment on record. Similarly, learned advocate shall place on record the copies of the depositions.

The record and proceedings be called before the next date.

Stand over to 9th September, 2024 for final hearing at admission stage.
