The application for condonation of delay of 3 days which is caused in preferring the appeal against acquittal. The reason mentioned in the application is that as the applicant was out of station and was not aware about the passing of the order passed by the Judicial Magistrate, First Class.

Considering the reason mentioned in the application, delay of 3 days is condoned subject to deposit of costs of Rs.1,000/-.

The applicant shall deposit the costs within two weeks. After depositing the costs, application for leave to file appeal be numbered and notice be issued to the non-applicant, returnable after four weeks.
