Having heard learned Counsel for the applicant and the learned Special Public Prosecutor, despite specific directions issued by this Court in Criminal Application No. 563 of 2023 on 28th July 2023 while setting aside the charge framed by the Special Judge in Special Case (NDPS) No.352 of 2020, it appears that the learned Special Judge has not followed the said directions in its letter and spirit while again framing the charge qua the applicant on 9th January 2024, in the sense, the charge which was framed on 5th

916-153-2024-APL=.doc April, 2023 appears to have been reproduced again on 9th January 2024.

Since there is non-compliance of the directions of this Court vide an order dated 28th July 2023 (Coram : Sarang V. Kotwal, J.), Registry to place the matter before the Hon'ble the Chief Justice for soliciting appropriate directions.
