The Petitioner challenges the FIR dated 18th January 2024 registered with Kolsewadi Police Station, Dist. Thane vide C.R. No.86 of 2024 for offence punishable under Section 295(A) of the Indian Penal Code (for short "IPC"). It is alleged that the religious banner was installed by the applicant above the wine shop. 2.

Learned Advocate for the Applicant submitted that the FIR has been registered on account of political rivalry. By no stretch of imagination, offence under Section 295 (A) is made out. 3.

Issue notice to Respondent No.2, returnable on 4th July 2024. 4.

In the meantime, no coercive action shall be initiated against the Applicant.
