We have heard the learned Advocates appearing for the parties and have perused the order dated 18th March, 2024. 2.
When called upon to address the Court on the cooperation to be rendered to the investigation agency, the learned Senior Advocate representing the Petitioners submits on instructions, that the authorized representative of the Applicants'
Company, namely, Mr.Soham Basak, is willing to appear before the Investigating Officer on all such dates and at such times as the Investigating Officer may desire. Independent of the directions of this Court set out below paragraph No.6 of the order dated 18th March, 2024, if the Investigating Officer calls upon the Accused persons to individually appear before him in the process of investigation, they are obliged to do so and would always cooperate. 3.
In view of the above statement, we expect Mr.Soham Basak to appear before the Investigating Officer of Charkop Police Station, Brihan Mumbai, on every Tuesday and Friday, beginning from 28th January, 2025 at 10.00 am and would participate in the interrogation upto 2.00 pm on such dates. This exercise shall be performed for a period of four weeks, meaning thereby, for four Tuesdays and Fridays.

If the Investigating Officer independently calls upon any of the Accused, they shall co-operate in the investigation and shall respect the intimations/ notice served upon them. Denial to appear will be viewed seriously by this Court which may warrant vacation of the ad-interim order passed earlier.

List this Application on 3rd March, 2025, in the urgent admissions category.
