By the present Application, the Applicants have sought for the following substantive relief "(a) this Hon'ble Court may be pleased to call for the records and proceeding of C.C.No.221/PW/24 arising from C.R.No.569 of 2023 of Worli Police Station, pending before the Ld. Metropolitan Magistrate, 62nd Court, Dadar, Mumbai."

Ms. Sachi Lodha, learned Advocate for the Applicants, submits that during pendency of the present Application, the Applicants had applied for discharge in CC No.221/PW/24. She states that by order dated 08 December 2025 the Court of

(28) APL-527.24.DOCX Judicial Magistrate First Class, 62nd Court, Dadar, Mumbai has rejected the said Application for discharge. She submits that the Applicants have an independent remedy against the order dated 08 December 2025. She, therefore, on instructions from the Applicants, craves leave to withdraw the present Application with liberty to file a Revision Application against the order dated 08 December 2025 before the Sessions Court.

Ms. Pallavi Dabholkar, learned APP for the Respondent/State, submits that the recourse suggested by Ms. Sachi Lodha is the correct recourse.

In view of the request made by Ms. Sachi Lodha, learned Advocate for the Applicants, leave granted to withdraw this Application with liberty as prayed for.

In view of above, the Criminal Application No.527 of 2024 is disposed of as withdrawn.

All contentions of respective parties are left open to be agitated in the proposed proceedings that would be filed by Ms. Sachi Lodha, learned Advocate for the Applicants. (ASHWIN D. BHOBE, J.)
