This is an Application for quashing of the chargesheet. However, learned counsel for the Applicant stated before the Court that the Applicant had preferred an application for discharge before the trial Court. It was rejected. Thereafter, he had preferred a Revision Application before the Sessions Court. It was also dismissed. In this situation, the only remedy available before him is to challenge those orders before the Single Judge Bench of this Court.

The present Application is for quashing of the charge-sheet. The case has travelled much beyond that. In this view of the matter, when we expressed our disinclination to grant relief of quashing of the charge-sheet, in this situation, learned counsel for the Applicant seeks withdrawal of this Application with liberty to challenge the orders of the trial Court and the Revisional Court through appropriate proceedings in accordance with law.

Permission is granted. The Application is allowed to be withdrawn with such a liberty. The Application is disposed of accordingly.
