Learned Advocate for the Applicant states that instant Application is filed under Section 482 of Criminal Procedure Code, under a bonafide belief that the impugned Order of issue process can be challenged only by way of such an application.

2) However, now the Applicant realized that the said Order of issue process can be challenged by way of a Revision before the Sessions Court and wants to file the Revision.

3) Hence, learned Advocate for the Applicant, on instructions, seeks leave to withdraw the Application with liberty to file an appropriate challenge before the Sessions Court.

6) Learned Advocate for the Respondent states that if the Applicant appears before the trial Court tomorrow i.e. on 3rd December 2024, the Respondent will not press for framing of charge/to explain the particulars against the Applicant, so as to facilitate the filing of Revision. Further, learned Advocate for the Respondent states that the Respondents will give no objection to condone the delay in filing the Revision.
